The Kansas Court of Appeals today affirmed a sentence from Wyandotte County District Court.
Calvin Cleveland Flenoy appealed a district court decision denying his motion, in which he claimed his sentence was illegal.
He pleaded guilty to aggravated robbery in an incident from January 2015. In May of 2015, he was sentenced to 7.5 years in prison with three years of postrelease supervision.
He claimed in his motion that his previous conviction in 1993 for aggravated robbery should have been counted as a nonperson felony, but his motion was denied at the district court level.
Today, in a summary disposition, the appeals court upheld the district court’s denial of his motion and affirmed the sentence. According to court documents, the state filed no response to Flenoy’s motion for summary disposition.
